1. Purpose

This policy describes when an amount may be refunded, how it is calculated and within what time. It supplements the terms and conditions, of which it forms part.

It distinguishes two situations, because they do not call for the same answer: bespoke services, paid after delivery, where there is almost never an amount to refund; and shop products, paid at the time of order, where a refund is possible and is described in Article 7.

2. Bespoke services: cancellation before performance starts

The Client may withdraw from the order in writing at any time before work begins. As no amount has been paid, no invoice is issued and nothing is owed on either side.

3. Bespoke services: cancellation during performance

Where work has begun, a Client who terminates remains liable for the part actually performed, assessed on the basis of the time spent and the interim deliverables handed over. A written statement is provided, together with the work carried out, and an invoice is issued for that amount alone, payable within fourteen days.

4. Non-performance or delay attributable to the Supplier

If the service is not performed as agreed and the failure is not remedied within a reasonable period after written formal notice, the Client may terminate the contract. The corresponding invoice is not issued or, if already issued, is cancelled by credit note. Any amount already paid is refunded in full.

For a consumer Client, that refund is made no later than fourteen days after termination, under Article L216-7 of the French Consumer Code.

5. Defects found after delivery

Defects reported within fifteen days of commissioning are corrected free of charge; they do not give rise to a refund. Where correction proves impossible, the refund covers the part of the price corresponding to the non-conforming function.

The following give rise to no refund: changes requested outside the agreed scope, a change of interface or pricing by a third-party publisher, the closure of a third-party service, or a modification made by the Client or a third party after commissioning.

6. Consumer right of withdrawal

A consumer Client concluding the contract at a distance has fourteen days from its conclusion to withdraw without giving reasons, in the conditions set out in Article 15 of the terms and conditions.

Where performance has not begun, nothing is owed and no invoice is issued. Where performance began at the consumer's express request, an amount proportionate to what has been supplied remains due under Article L221-25, set out in a written statement; as nothing was collected in advance, it is invoiced and there is no balance to refund.

7. Shop products

As shop products are paid for at the time of order, they can give rise to an actual refund, unlike bespoke services.

Products delivered within one to three working days

The consumer Client has the ordinary fourteen-day right of withdrawal. The order is refunded in full where withdrawal occurs before commissioning. Where configuration began at the consumer's express request, an amount proportionate to the work carried out remains due under Article L221-25 of the French Consumer Code, and the balance is refunded.

Digital content delivered immediately

Where the Client expressly requested immediate supply and expressly waived the right of withdrawal at checkout, content that has been supplied in full can no longer be withdrawn from, under Article L221-28, 13° of the French Consumer Code. No refund is due on that basis.

That limit does not affect the warranty in Article 14.6 of the terms: a product that does not match its product page is corrected free of charge and, where correction is impossible, refunded in full.

8. How refunds are made

Every refund is made in the currency of the original payment — Swedish kronor or euros — using the same payment method, without conversion and at no cost to the Client, unless the Client expressly agrees to another method that costs him or her nothing.

The refund is made no later than fourteen days after the Supplier is informed of the decision giving rise to it.

9. Complaints

Any complaint is to be made in writing, by email to contact@jakubcurij.fr or by post to Jakub Curij — Entrepreneur individuel, 12 rue Royale, 75008 Paris, France.

The Supplier acknowledges receipt of any complaint within five working days and provides a reasoned reply within thirty days.
